All Housing Solutions, LLC - Terms and Conditions
Payment Terms: Payment for all jobs is due upon Completion. If the job is longer than a week, weekly detailed progress invoices will be supplied with payment due upon receipt and the final payment (minus deposit / booking fee) is due the day the job is completed, just prior to us leaving. We do not offer extended payment terms.
Deposits / Booking Fee: A deposit, and/or booking fee is required for all jobs. The deposit amount will be equivalent to the full cost of estimated materials, the Materials Markup and 15% of the cost of labor. Deposits for labor will be refunded (minus the man hours put in to setup the job) if more than 48 hours notice are given and the materials required have not been ordered, and/or picked-up. Non-refundable or non-returnable items (tinted paint, custom items, etc.) cannot be refunded; they will become property of the customer.
Deposits / Booking Fee will be applied (credited) against the final invoice, at the end of the job and will serve as partial or full final payment. If a refund is owed to the customer (canceled job with more than 48 hours notice, or there is a surplus credit at the end of the job), a check will immediately be issued, payable to the person/company who supplied the deposit check. See "Short Notice / Canceled Jobs" below for more information.
Deposits / Booking Fee for Sub-contractors: A deposit and/or booking fee will also be required for Sub-Contractors, (Short Notice / Canceled Jobs section applies to Sub-Contractors too). Prior to the Sub-Contractor's materials, or tradesmen arriving on site, FULL ADVANCE PAYMENT MUST BE MADE payable to All Housing Solutions and will be held on behalf of the customer by All Housing Solutions until the job is completed and inspected by All Housing Solutions.
Short Notice / Canceled Jobs: If a job is canceled without 48 hours notice, there will be a charge for the lost time (equivalent to either the full amount of the job if less than a full day, or a full day worth of man hours, for each man scheduled to work).
In addition - If materials have been acquired for the customer, the 25% Materials Pick-Up fee will apply along with an additional 15% restocking fee. If the materials cannot be returned (example: tinted paint) the materials costs (if more than estimated) will be immediately payable in full, plus the Materials Pick-up fee; the customer may keep the materials upon request.
Forms Of Payment Accepted: Cash, *Check, Money Order, Certified Check. Credit Card Payments will be subject to a 5% surcharge on the total bill and can be processed on our website. Checks should be made payable to "All Housing Solutions, Llc". If a check is the desired form of payment, it must be certified if over $1,000.00. Exception: Deposits / Booking Fee excluded unless job is to begin within one week from booking date.
Hourly Rates: Range between $55.00 - $85.00 per man hour (usually $65.00 per man hour with a two man hour minimum) Our rates include the costs of transportation, tools and up to 20 minutes travel time to and from the job site. The hourly rates begin to be charged from when we arrive on site and begin from setup, until we have cleaned-up, loaded our tools and are ready to leave. Outside of Sussex, Warren, Morris County a minimum 30 Minute Travel Time Surcharge will apply.
Man Hours: Man hours are the number of hours worked by each individual working on site. For example, if there are two men on site and they work for 4 hours, then 8 man hours will be charged. If the second man is classed as our "Handyman Helper", then the hourly rate for the helper may be less than our regular rates.
Handyman's Helper: occasionally, if the job allows, we can charge out a lower rate for our Handyman's Helper (as low as 50%-75% of our regular rates), saving you money; keeping our skilled labor working on your project, while the helper can assist in setup, cleanup, running for tools, in addition to doing part of the job, etc. This will allow us to get the job done faster and at an overall lower average man hour cost. This lower fee will be determined prior to the job starting, if it is not pre-determined, then regular hourly rates for man hours worked will apply for every person working on site.
General Contracting: If we are hired to manage a larger project and it requires the work of Sub-Contractors (job requires multiple tradesmen such as a Plumber, Electrician, Pipe Fitter, Framer, Mason, etc.) we will handle and manage the entire job from beginning to end, including the quoting process, recommending / selecting the trades, scheduling the trades, quality control, communication between customer and sub-contractor and management of their payment.
General Contracting Fee: is equal to 20% of the Sub-contractors total invoice, including their materials and taxes.
General Contracting - Customers Advantage: As we deal with multiple sub-contractors on a regular basis, we have established better pricing with who we consider to be the best service providers in the area. The pricing that we obtain on our customers behalf will likely be less than what a customer could obtain on their own as the sub-contractors consider the amount work that we provide them (volume discount) and the time they save in having to deal directly with the customers. Furthermore, we know how the work should be done, so we serve as your knowledgeable "eyes on the job" to ensure that the job is done right and no short-cuts are taken.
Materials: All materials will be offered at Contractors Pricing, however they will be subject to a 25% surcharge to pick them out, or have them delivered (hourly rates will apply if the materials costs are less than $200 or the materials are more than 10 minutes outside of the Tri-county area and additional delivery charges may apply if there are delivery fees from the supplier).
Materials Returns: There will not be a credit or refund for materials if there is a reasonable amount of material left over (not more than 15%). If All Housing Solutions has acquired over 15% more material than required and some needs to be returned, there will be a credit offered for the remaining amount. However, if the remaining materials are left with the customer, the customer will be charged for them.
Customer Supplied Materials: If customer supplies materials, there is no surcharge applied, UNLESS the materials supplied are incorrect, there are not enough materials supplied (always buy an extra 15% to ensure there are enough) and more has to be obtained, or we show-up, or we are given less than 48 hours cancellation notice and materials are not on site. If a materials list has to be developed by All Housing Solutions, we will charge our hourly rate to compile the list.
Consumables: such as nails, screws, glue, blades, etc. may be charged for as materials, depending on the size of the job.
Estimates: All Estimates are FREE if we do the job for you, but there may be an initial cost to do an estimate, starting at $65.00 plus tax, payable upon delivery of estimate.
Depending on how elaborate the job to be estimated is, we may charge our hourly rate to complete the estimate. Customers will be informed of any charges and will be in agreement of them prior to All Housing Solutions starting the estimate. Estimates are not a guarantee of price, they are time and materials agreements; if there are any unforeseen issues that arise, or if any changes to the scope of work are requested, the original estimate becomes null and void. If a new estimate is requested, the work will stop immediately until a new estimate is completed; all work done up to the point work is stopped, is due for immediate payment.
Change Orders: Any substantial changes that will affect the price by more than 15%, or more than $1,000.00, (meaning; additional work requested, issues that have been identified after work has been started, a large component removed, etc) to the scope of work (what is laid out in either the Estimate Or Quote) will only be done with a signed Change Order and will become an addendum to the original estimate or quote. If the change is substantial and a Change Order is not signed off on immediately, unless an email or voice mail is received, all work may stop immediately until a Change Order is written and signed by the customer and All Housing Solutions. Regardless, any work done with either verbal, or written authorization is considered implied consent and the extra work will be charged for.
Quotes: Available only upon request. The initial cost for All Housing Solutions to provide a Quote is the same as doing an estimate (see above), however, Quote costs are not refunded, even if we do the job for you. Quotes will usually be priced about 25% or more to do than an estimate as we have to take into account any potential unforeseen issues that may arise.
Piece Work: Some jobs are quoted on a per piece basis (window installations, interior door installations, etc.) and are a fixed price per piece; unless there is hidden damage that could not be pre-assessed when the job was quoted (rotten sill, improper building paper application, etc.). If this is discovered and an extra cost to repair the damage is required to proceed, then a Change Order will be added to the original contract. If the job calls for a combination between Piece Work and Time and Materials, then the time spent doing non-piece work will be tracked and billed as agreed.
Labor Costs / 10% Labor Surcharge: Labor rates will be determined and based upon the scope of work, the tools required to perform the job, the skills required to perform the job, etc. The usual rate is $65.00 per hour and is subject to 10% Labor Surcharge (example - additional $6.50/hr) to cover the costs of Administration, Overhead, Liability Insurance and Licensing, etc. Neither the Materials costs nor the Materials Pick-up fee are subject to the 10% Labor Surcharge.
Seniors Rate Discounts: Seniors Rate Discounts are offered to homeowners, 65 and older, who live at the premises we do the work at and is the person who pay us to do the work. The 10% Labor Surcharge will be waived for Seniors. Seniors Rate Discounts do not apply to commercial properties, rental properties, or any property that is not their primary residence.
Dump Costs: If the job has a reasonable amount of waste (material cut-offs, etc.), equivalent to a single garbage can, they will be hauled away and dumped on the customers behalf for free, if there is more (more than a single garbage can) there will be a $75.00 dump fee added to the cost of the job, plus an hourly rate may apply if there is a substantial loading and/or unloading time. If there are restricted materials (more than two sheets of Drywall, paint, any TV's, etc.) that have to go to a separate dump location, a second $75 dump fee and additional man hours will apply.
The customer may agree to dispose of the waste themselves; in this case, no dump fee charges will apply.
Late Payment: A payment is considered "Late" if it is not made when agreed; if not paid upon completion of work. In some cases it may take a few days to compile all material and sub-contractor invoices, payment in these cases will be due upon receipt of final invoice. Furthermore, if payment is not received within 3 business days, a Builders Lien will be placed on the owners’ property to secure the debt and the time to place the lien and the fees associated with placing the lien, will also be charged to the customer.
In addition to the Builders Lien being put in place, total outstanding invoice amounts will be charged at a rate of 24% annual interest (2% compounded monthly) and if a collection agency has to be hired, a 30% surcharge on the total invoice will be applied.
Quality Workmanship Warranty
All labor performed by All Housing Solutions and General Contracting and their Sub Contractors will be warranted for quality workmanship for a period of one year from the date of installation, or manufacture, up to a maximum of eight man hours within the Warranty Period.
And the first two man hours of labor to repair, or replace the materials supplied by All Housing Solutions and General Contracting, or their Sub Contractors (customer supplied materials have no warranty on labor) and installed will also be covered for the period of up to one year, or as long as the manufacturer warranties their product (up to one year).
